Terms of Use – CarbonPro

1. General information

This website (the Site) is operated by Nyxeo Group S.L., with registered address at 21, carrer Sardà, 08231, Ullastrell, and contact email hello@carbonpro.io (hereinafter, CarbonPro).

CarbonPro provides a digital solution focused on structuring, calculating, analyzing, and generating carbon footprint indicators associated with logistics and transport operations, in accordance with recognized methodologies, including, among others, ISO 14083 and the GLEC framework.

2. Purpose of the Site

• Present the CarbonPro solution and its functionalities.
• Allow interested companies to request information or access to the service.
• Provide authenticated access to the CarbonPro application to authorized users.
• Access to certain functionalities may be subject to prior validation and acceptance of additional conditions applicable to the service.

3. Service access and progressive rollout

• CarbonPro is offered under a B2B model with access subject to prior validation.
• Service functionalities may evolve based on technical, regulatory, or methodological improvements.
• CarbonPro reserves the right to modify, update, or suspend the Site or the service in whole or in part, ensuring, where possible, reasonable continuity of access for authorized users.

4. Permitted use

• Use the Site and the service in accordance with applicable law and these Terms.
• Do not use the service for unlawful, fraudulent, or bad-faith purposes.
• Do not access or attempt to access systems, data, or restricted functionalities without authorization.
• Do not reproduce, copy, modify, or reuse the service or its components without express authorization.

5. Intellectual property

All content of the Site and the CarbonPro service, including but not limited to texts, interfaces, schemes, methodologies, taxonomies, algorithms, and software, is owned by CarbonPro or its licensors and protected by intellectual and industrial property laws.

Data provided by clients and the results generated from such data remain the property of the client, without prejudice to the usage rights defined in these Terms.

6. Service data and results

CarbonPro acts as a technology provider that:

• Processes operational data provided by the client for the delivery of the service.
• Generates results and derived indicators in accordance with the applicable methodologies.
• Returns those results to the client through the channels defined in the service.

CarbonPro does not act as an auditor or certification body, and use of the service does not replace the client's final regulatory obligations.

6.1 Use of anonymized and aggregated data

CarbonPro may publish its own data products created from anonymized and aggregated data that do not allow the direct or indirect identification of clients, individuals, or specific operations.

These data products may be made available in governed data-sharing environments for sector analysis, benchmarking, aggregated reporting, or general-interest purposes.

CarbonPro data products are based on multiple anonymized sources and are structured according to a neutral, proprietary taxonomy, with no semantic or technical linkage to specific clients.

6.2 Separation between CarbonPro data products and client data

The data product published by CarbonPro corresponds exclusively to aggregated and derived indicators defined by CarbonPro as an independent data provider.

Operational, structured, or detailed data generated within the platform (including, by way of example, per-shipment formats, specific configurations, or a client's internal structures) are considered for the client's internal use and are not part of CarbonPro's published data product.

CarbonPro does not publish data on behalf of its clients nor act as their representative before third parties or external platforms.

7. Limitation of liability

CarbonPro makes reasonable efforts to ensure the quality, consistency, and traceability of the calculations and data generated. However:

• The service does not replace official audits or regulatory certifications.
• CarbonPro will not be liable for business, regulatory, or commercial decisions made based on use of the service.
• The service is provided in accordance with the state of the art available at any given time.

8. Applicable law

These Terms are governed by Spanish law, without prejudice to applicable European regulations in the areas of data, digital services, and information protection.
